Certificates of authorization

Installation of a pool or spa

In accordance with the Bylaw on the security of residential pools (provincial gouvernment) a certificate of authorization is required to install an in-ground swimming pool or private spa that is more than 60 cm deep. Authorization to build or install an in-ground pool also provides for the construction and installation of the related accessories.

Location

The construction and installation of an in-ground pool on a plot of land are authorized provided that the following conditions are met:

• The pool must be installed in the side yard or backyard of the residence, except in the case of a multi-family dwelling, where the pool may be installed in the front yard.
• A certificate of authorization is required before building and installing an in-ground pool.

The installation of an above-ground pool also requires a certificate of authorization (Bylaw on the security of residential pools, provincial gouvernment) provided that the following conditions are met:

• The pool must be installed in a side yard or backyard.
• If the pool is equipped with a ladder or exterior access stairway, a device that keeps the stairway or ladder raised is compulsory, so as to prevent access to the pool.

Please note that installation of an above-ground pool is prohibed in the L'Île-des-Soeurs neighbourhood.

A spa is authorized, with a certificate of authorization, as an accessory structure, provided that the following conditions are met:

• The spa must be installed in a side yard or backyard.
• The spa must be equipped with a cover that is closed and locked, at all times, when not used.

The pool or spa must not be placed under an overhead electrical wire. Contact Hydro-Québec to determine the minimum clearance required.

Important

The pool or yard in which it is located must be surrounded with a fence; the gate of the fence must be equipped, at all times, with an automatic locking system. The fence must be between 1.50 metres and 1.85 metres in height. It may contain no openings of more than 7 cm and its horizontal posts may be no less than 1 metre apart.

In the L'Île-des-Soeurs neighbourhood, fences and small walls must consist of permanent, authorized materials.

Communal pool for housing units

Pools serving nine or more non-condominium housing units must comply with bylaws adopted pursuant to the Public Buildings Safety Act and the Environment Quality Act.

Procedure

Submit your pool certificate of authorization application to the Direction de l’aménagement urbain et des services aux entreprises, along with:
•  A scaled installation plan showing the property lines, the existing structure, the pool's size and location, the required fence and any accessory equipment that has to be installed, such as a pump, filter, water heater or heat pump
•  Construction and structural details or cross-section
•  Data sheets for the accessory equipment
•  Copy of the location certificate
