  Legal framework
The city’s Web site administers the use of personal information pursuant to the following laws:
  • Charter of Human Rights and Freedoms (R.S.Q., chapter C-12).
  • Personal Information Protection and Electronic Documents Act (S.C. 2000, chapter 5).
  • An Act respecting Access to documents held by public bodies and the Protection of personal information (R.S.Q., chapter A-2.1).
  • Archives Act (R.S.Q., chapter A-21.1).
  • Civil Code (articles 35 to 41).
  • Bill 86 (2005): amending an Act respecting Access to documents held by public bodies and the Protection of personal information and other legislative provisions.
The city’s Web site is not designed to collect personal information on users. Access to the site is anonymous.

However, when necessary in certain cases, the city may ask a user who wishes to receive a particular service to provide personal information such as his or her name, civic address and email address, as described below. Users may refuse to provide such information, but they will not be able to perform the desired transaction or obtain the requested access. Your e-mail address will not in any case be recorded without your consent.

The information provided in the forms you complete (directly on line on in an Accès Montréal office) will be treated confidentially in accordance with Québec statutes.

Instances in which personal information is collected by the city
Aware of its obligation to protect all personal information that could be sent to it by users of its site, the city notifies users of which information is being collected and the use that will be made of it. If the user agrees to provide the requested information, he or she will be deemed to have consented to its collection and use by the city. If personal information provided by users could be used for purposes other than those listed below or that could reasonably result from such use, the city will so advise the user and obtain the latter’s consent, except where exempted from doing so by law.

Non-disclosure to third parties
If you communicate personal information to the city over its Web site in the form of a message, to subscribe to a service or to make a payment, please note that the city does not sell, market or lease third party information provided by users.

The city agrees not to disclose personal information provided by users to third parties, except when such information is bundled with other information in such manner that no particular user can be identified from it. This means user names and addresses will not be disclosed, but we may publish information of strategic value in our surveys. For example, we may report that “50% of those who have used the city’s site are Montréal residents between 25 and 45 years of age and 25% reside in Europe.”

The city does however reserve the right to transmit personal information about you to protect the property rights of its site or those of its users, sponsors, advertisers or suppliers when so required by law.

Right of access and of modification
Subject to limits provided by law, you are entitled at any time to access, after, correct and, where permitted, to delete personal information that you have provided on the city’s Web site. Requests under An Act respecting Access to documents held by public bodies and the Protection of personal information should be sent to the Direction du Greffe, 275 rue Notre-Dame Est, suite R-134, Montréal (Qc) H7E 1C6. Please refer to the Customer Service of the appropriate online service for more information.

Should no such request be made, the city will apply its calendar for managing, archiving and destroying personal information under to the Archive Act (R.S.Q., chapter A-21.1).

Do not transmit confidential information, such as your password, by email.

If you must send such information to the city, please call the Customer Service department of the appropriate online service first.

Secure transactions
Any information you sent to the online service site, such as your name, civic address, email address or any other personal information, is encrypted using the state-of-the-art 128-bit SSL SSL (Secure Socket Layers protocol) protocol.

You must employ a 128-bit encryption browser to use this system. A 128-bit encryption browser version may be downloaded from your browser’s Web site.

Please note that it is the Internet payment service, not the city, which ensures online payments. During subscription or the provisioning of your online account, when you are requested to provide your credit card information, you are no longer connected with the city’s Web site, but with the internet payment service’s Web site.

Once the charge has been processed by the internet payment service, the city will receive an electronic acknowledgement that payment has been made for the required amount. No other information is transmitted to the city by the internet payment service, apart from amount paid.

Security icons
Your browser will display a security icon and message if the page on which you are entering data is secure. The English versions of Microsoft Explorer and Netscape display a lock. The French version of Netscape displays a small blue key in the lower corner of your screen.

Note: An open lock or a broken key means the link is not secure.

A page is secure if an “s” is included in the URL displayed by your browser (“https” rather than just “http.”)

Credit cards
Visa and MasterCard are accepted.

City security systems
The city’s server is equipped with a firewall that controls access to information the city wishes and is required to keep confidential. Furthermore, the city’s server is equipped with a security certificate ensuring the confidentiality of all data sent to it.

The city is not responsible for malicious use of personal information transmitted to it through its online service. However, the city reserves the right to resort at any time to the necessary measures to ensure the confidentiality of data entrusted to it.

A cookie is a string of data that is transmitted by a Web site to your browser and that resides temporarily in your browser’s memory or on your computer's hard drive.

Any person who accesses the online service site must configure their browser to accept the presence of cookies.

Cookies must also be enabled before you can the online service, so that we can ensure we are dealing with the proper party.

The cookies used on the city’s transactional site cannot seek out any other type of information on your hard drive. Once you leave our Web site, these cookies become non-functional.

Most browsers are configured to accept cookies, but certain users set their browsers to refuse them. If this is your case, you must enable cookies before you can use the site.

Connection broken
Your connection will automatically be terminated after 30 minutes of no activity in the online site. To resume using the site, please re-enter your user name and password.

Links to other sites
The online services Web site provide links to other services proposed by the city and such sites may in turn provide links to still other sites.

The city assumes no responsibility for the information that you may transmit over such sites. When using these sites, please make sure to take the necessary precautions.
