TO INDIVIDUALS QUALIFIED TO VOTE and eligible to be registered on the referendum list of the BOROUGH

 

PUBLIC NOTICE IS GIVEN AS FOLLOWS:

 

At a regular meeting of the borough council held on Tuesday, February 2, 2010, the council adopted the following by-laws:

 

 

By-law RCA10 210001

 

By-law authorizing a loan of $2,255,000.00 to renovate various borough buildings.

 

This by-law authorizes the borrowing of $2,255,000.00 over a period of 20 years; said loan will be charged to borough taxpayers.

 

 

By-law RCA10 210003

 

By-law authorizing a loan of $2,372,000.00 to replace borough vehicles and equipment.

 

This by-law authorizes the borrowing of $2,372,000.00 over a period of 5 years; said loan will be charged to borough taxpayers.

 

Individuals qualified to vote and eligible to be registered on the referendum list of the entire borough territory may request that By-laws RCA10 210001, and RCA10 210003 be the subject of a referendum, by registering their name, address and qualification in the registers opened for these purposes.

 

The required number of registered requests to submit these by-laws to a poll is 921 for each by-law.

 

Failing such number, these by-laws will be deemed approved by persons qualified to vote.

 

Said by-laws may be consulted at the borough hall, room 102, 4555 rue de Verdun, during regular office hours, Monday through Friday, from 9:00 a.m. to 5:00 p.m., from the day of publication of this notice.

 

Results of this consultation by registration procedure will be announced at 7:00 p.m. or as soon as possible afterwards on Tuesday, February 16, 2010, in the council chamber of the borough hall, 4555 rue de Verdun.

 

REGISTRATION PROCESS

 

Place:             Room 102, borough hall, 4555 rue de Verdun.

 

Date:              Tuesday, February 16, 2010.

 

Time:              9:00 a.m. to 7:00 p.m.

 

CONDITIONS TO BE A QUALIFIED VOTER

 

Conditions to be a qualified voter and entitled to be entered on the referendum list of the borough:

 

a)     A person must, on February 2, 2010, date of the adoption of these by-laws, and when exercising this right, meet one of the following two requirements:

 

1.   Be a natural person residing in the borough and have been domiciled in Quebec for at least six months, and:

 

·        Be of legal age;

·        Be a Canadian citizen;

·        Not be under curatorship;

·        Not be deprived of election rights, pursuant to the Act respecting elections and referendums in municipalities (R.S.Q., c. E-2.2).

 

2.      Be a non-resident natural person or a corporate body, for at least twelve months, and:

 

·      The owner of an immovable or the occupant of a place of business located in the borough; and

·      Not be deprived of election rights, pursuant to the Act respecting elections and referendums in municipalities (R.S.Q., c. E-2.2).

 

b)     A corporate body qualified to vote must designate, by resolution, a member, an administrator or an employee to exercise this right to vote. 

 

       This designated person must also, on February 2, 2010:

 

·        Be of legal age;

·        Be a Canadian citizen;

·        Not be under curatorship;

·        Not be deprived of election rights, pursuant to the Act respecting elections and referendums in municipalities (R.S.Q., c. E-2.2).

 

c)      Co-owners of an immovable qualified to vote in the sector concerned must designate, by power of attorney signed by the majority of them, a person to exercise this right.  However, this person must not already be entitled to be registered on the referendum list under a higher ranking capacity such as:

 

1.   a domiciled person;

2.   a sole owner of an immovable;

3.   a sole occupant of a place of business.

 

d)     Co-occupants of a place of business qualified to vote in the sector concerned must designate, by power of attorney signed by the majority of them, a person to exercise this right.  However, this person must not already be entitled to be registered on the referendum list under a higher ranking capacity such as:

 

1.   a domiciled person;

2.   a sole owner of an immovable;

3.   a sole occupant of a place of business;

4.   an undivided co-owner of an immovable.

 

e)     A corporate body, co-owners and co-occupants must present their resolution or power of attorney during the registration.  Said document is valid unless substituted.

 

 

Mandatory identification

 

In order to sign the register, a qualified voter must establish his identity by presenting one of the following documents:

 

·        his medicare card;

·        his driver's license;  or

·        his Canadian passport.
